Work Schedules

Work schedules for employees vary throughout our organization. Supervisors will advise employees of their individual work schedules. Staffing needs and operational demands may necessitate variations in starting and ending times, as well as variations in the total hours that may be scheduled each day and week.

REGULAR FULL-TIME & PROBATIONARY SHIFT EMPLOYEES

These are employees who work schedules that fall under subsection 207 (k) of the Fair Labor Standards Act (FLSA) and are considered nonexempt.

DEFINITIONS

TOUR OF DUTY:

Refers to the period of time during which an employee is considered to be on duty for purposes of determining compensable hours. The time may be scheduled by "shifts" or unscheduled periods of time spent performing work outside the "shift". Examples of unscheduled periods of time include time spent handling emergency situations and time spent working after a shift to complete an assignment. The tour of duty does not include time spent substituting for other employees by mutual agreement ("trading time").

SHIFT:

Time during which the employee is regularly assigned. Each shift shall be twenty-four (24) hours in length and shall commence at 0700 each day. Regular full-time and probationary shift employees are on duty for twenty-four (24) hours, off duty for twenty-four (24) hours, on duty for twenty-four (24) hours, off duty for twenty-four (24), on duty for twenty-four (24), and off duty for ninety-six (96). Unless emergency situations dictate otherwise, no more than two (2) personnel from any shift may be scheduled to be off duty simultaneously.

WORK PERIOD:

The normal work period for regular full-time and probationary shift employees shall be twenty-seven consecutive days long and shall average one hundred and ninety-two (192) hours worked based upon eight (8) shifts worked within that period to compute that average. Regular full-time and probationary shift employees shall be separated by the Assistant Chief into three groups, each group designated to work on one of three successive days and each third day thereafter.

KELLY DAY:

A rotating off duty period in addition to the normal off duty schedule. In an effort to maintain compliance with the Fair Labor Standards Act (FLSA) and keep overtime costs to a minimum, the District shall schedule six (6) Kelly Day's per calendar year for each regular full-time and probationary shift employee.

OVERTIME PAY:

For all compensable hours worked within the specified work period in excess of the FLSA's maximum limit of two hundred and four (204) hours, the employee shall receive compensation at one and one-half times his/her regular rate of pay. Exceptions to this rule would include any hours of paid leave, "traded" time between employees, and any other exceptions allowed by the FLSA that occur within a work period.

TRADING TIME:

The 1998 Amendments to the FLSA provide that any individual employed by a public agency may agree to substitute, during scheduled work hours, for another employee. Employees may work substitution schedules (i.e. "trade time") where the substitution is: (1) voluntarily undertaken and agreed to solely by the employees and (2) approved by the employer. The District requires that all substitutions or "trades" must occur within the same work period and that all employees involved within a "trade" must have the same qualifications for the positions being filled. (i.e., A Fire Specialist that is assigned to operate an engine cannot "trade" time with another employee who is not qualified to operate fire apparatus. Also, a Firefighter/Paramedic who is assigned to provide patient care in an ambulance cannot "trade" time with an employee that is only licensed as an EMT-B.) Activites during traded days are personal to the employee and once approved, such "traded days or trade time" will be considered as routine time off for the employee. All traded time must be scheduled twenty four (24) hours in advance. Any traded time that does not meet the twenty four (24) hour requirement must be approved by an Assistant Chief or the Chief of the Department.

REGULAR FULL-TIME & PROBATIONARY CLERICAL EMPLOYEES

These are employees who are scheduled to work forty (40) hours per week and are considered to be nonexempt.

DEFINITIONS

SHIFT:

The regular shift for full-time and probationary clerical employees shall commence at 0800 and end at 1700 each Monday through Friday, inclusive. Within each shift, employees in this category shall receive a one (1) hour meal period. During this meal period the employee shall be completely relieved from performing any duties and is free to leave District property, therefore the meal period is considered as noncompensable time.

WORK PERIOD:

The specified work period for regular full-time and probationary clerical employees shall be seven (7) consecutive days long and shall average forty (40) hours worked based upon five (5) shifts worked within that period to compute the average.

OVERTIME PAY:

For all compensable hours worked within the specified work period in excess of the FLSA's maximum limit of forty (40) hours, the employee shall receive compensation at one and one-half times his/her regular rate of pay. Exceptions to this rule would include any hours of paid leave and any other exceptions allowed by the FLSA that occur within a work period.

REGULAR FULL-TIME SALARIED EMPLOYEES

These are employees that meet either the criteria for Executive positions as outlined in subsections 541.1 or 541.101 of the FLSA or the criteria for Administrative positions as outlined in subsections 541.2 or 541.201 of the FLSA. Employees in the Executive and Administrative categories are considered exempt.

DEFINITIONS

SHIFT:

These employees work a forty (40) hour flex-time schedule. Taking into account emergency responses and business requirements that may dictate being on duty at times other than during normal business hours, employees in this category may alter their daily routine so as to accommodate these special needs. Employees in this category may start their workday as early as 0700 or as late as 0900 each weekday, but should attempt to maintain office hours from 0900 through 1500 each weekday.
